Terms of Service – Executive Speaking Success

1. Acceptance of Terms: By accessing and using the services provided by Executive Speaking Success (“the Company”), including but not limited to personalized coaching, leadership training for corporate executives, pitch coaching for startups, TEDx and speaker coaching, and SMS messaging services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services: The Company provides leadership communication coaching, public speaking training, and related services. This includes personalized coaching for corporate executives, pitch coaching for startups, and TEDx and speaker coaching. The specific details, duration, and pricing of services will be agreed upon separately between the Company and the client.

3. SMS Messaging Service: As part of our service, we provide appointment reminders and confirmations via SMS messaging. By signing up for our services, you agree to receive these SMS messages. You can cancel the SMS service at any time by texting “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to somebody@executivespeakingsuccess.com. Please note that carriers are not liable for delayed or undelivered messages. Message and data rates may apply for messages sent to you from us and to us from you. For questions about your text plan or data plan, contact your wireless provider.

4. Payment: Fees for services are due as specified in individual agreements. The Company reserves the right to suspend services for non-payment.

5. Intellectual Property: All materials, methodologies, and content provided by the Company are protected by copyright and other intellectual property laws. Clients may not reproduce, distribute, or create derivative works without express written permission from the Company.

6. Confidentiality: The Company respects client confidentiality and will not disclose sensitive information shared during coaching or training sessions, except as required by law or with client permission.

7. Cancellation and Refunds: Cancellation policies and any applicable refunds will be outlined in individual service agreements.

8. Disclaimer of Warranties: While the Company strives to provide high-quality services, we make no guarantees about specific outcomes or results from our coaching or training.

9. Limitation of Liability: The Company’s liability is limited to the amount paid for services. We are not liable for any indirect, consequential, or incidental damages.

11. Governing Law: These terms are governed by the laws of the state of California, United States.

12. Changes to Terms: The Company reserves the right to modify these terms at any time. Continued use of services after changes constitutes acceptance of the new terms.
